Terms and Conditions
Effective date: July 15, 2026. These Terms and Conditions describe basic rules for using Honest Elf's website, pilot process, and managed e-filing services.
Use of the service
You may use Honest Elf only in compliance with these terms, applicable laws, court rules, filing-provider requirements, payment-provider requirements, and any written agreement between you and Honest Elf.
Managed e-filing
Honest Elf provides managed filing operations that may include intake, submission, rejection handling, status pullback, and customer system updates. Specific scope, jurisdictions, service levels, pricing, pilot commitments, and go-live conditions are governed by the applicable written agreement.
Customer responsibilities
You are responsible for the accuracy, completeness, authorization, and legal sufficiency of filing materials, case data, attorney approvals, payment account setup, court credentials when applicable, and instructions you provide to Honest Elf.
Attorney involvement
Honest Elf does not replace attorney review or professional judgment. Customers remain responsible for attorney supervision, meaningful attorney involvement, filing authorization, compliance obligations, and decisions about whether and how a filing should be submitted.
No legal advice
Honest Elf is not a law firm and does not provide legal advice. Operational filing support, data processing, rejection handling, and status updates are not legal opinions or legal representation.
Customer content and systems
You retain ownership of information and materials you provide. You grant Honest Elf the rights needed to operate, provide, secure, support, and improve the service, including processing exports, filings, court responses, and updates to your designated systems.
Court fees and payment accounts
Unless otherwise agreed in writing, filings run through the customer's own court payment account. Court fees, provider fees, payment failures, chargebacks, and related payment obligations are the customer's responsibility.
Third-party services
The service may interact with courts, e-filing providers, court payment processors, case management systems, and other third-party systems. Their rules, certifications, availability, changes, and outages may affect filing workflows.
Acceptable use
You may not misuse the service, interfere with its operation, attempt unauthorized access, submit unlawful or unauthorized materials, reverse engineer protected components, or use it for unlawful activity.
Disclaimers
The service is provided on an as-is and as-available basis except as expressly stated in a written agreement. Honest Elf does not guarantee uninterrupted availability, court acceptance of every filing, or any particular legal outcome.
Limitation of liability
To the fullest extent permitted by law, Honest Elf will not be liable for indirect, incidental, special, consequential, or punitive damages.
Changes to these terms
We may update these terms from time to time. Continued use of the service after an update means you accept the revised terms.
